Revenue through advertising is projected to reach INR 1,232.70 billion (US$ 18.39 billion) in FY23. It was INR 608.30 billion (US$ 9.44 billion) in FY18.

Registration And Licensing

2. Partnership firm.

At least two individuals are required to start a partnership firm. You need a registered partnership deed along with a current bank account and service tax registration. A partnership firm is appropriate when the partners have a common vision and are willing to share profits.

3. Private limited company.

A private limited company needs to at least two directors with a minimum investment of INR 1 lakh. It’s best for startups seeking funds from investors.

4. Limited liability partnership.

It is the combination of private limited company and partnership firm. You need at least 2 partners. A limited liability partnership has more agreement requirements when compared to an ordinary partnership firm. This setup is ideal when your budget is less than INR 10,000 and you want to enjoy the perks of setting up a company.

5. One person company.

It is similar to a private limited company but comprises only one person.

Legal Procedure Before Launching

  • Register the domain name. Get a unique domain name for the media company by paying the registration fee. One needs to submit valid address and ID proofs for the registration process .
  • Get the federal tax ID number. This process distinguishes your media company as a separate legal entity . You need to get a federal tax ID number from the Indian Revenue Services (IRS). IRS keeps a track of your business transactions using this ID.
  • VAT/Service tax. A company must apply VAT to its products and pay taxes to the government for services.
  • Memorandum of understanding with vendors/contractors. Be precise when drafting the 'memorandum of understanding' with your vendors/contractors so as to prevent forged services. The process may give rise to legal issues so you need to be careful while contracting. Add a disclaimer to your services/products to protect yourself from legal liabilities.
  • Investment in cyber security. Invest in cyber security to safeguard your customers’ financial transactions. Failure to protect customers’ data can cost you up to INR 5 crores in penalty.
  • Trade mark registration. Registration of trademark is important for web-based/online businesses.
  • Website terms & conditions. Set up the website’s legal terms and conditions such as the privacy policy, disclaimer, and third party data-sharing rules.
  • Vendor agreement. Draft an agreement by enlisting requirements such as payment policy, refund, and the taxes applied to the services/products from vendors.

For decades, these have been the only two routes to starting a TV channel. But, in the last few years, a new option has emerged that makes starting a channel of TV accessible to a lot more brands and individual creators: launching your TV channel online.

While local TV or cable is still the right choice for some content creators, starting a TV channel online is now the best option for most. It eliminates the need for raising capital, greatly reduces staffing costs, and makes it easier to monetize your content as effectively as possible (which is the whole point of creating a TV channel).

Step 1: Evaluate your content

The first step in creating a TV channel is understanding how your audience and viewers will relate to your streaming content. Most creators already have a clear understanding of what they have to offer, so this step won’t take long. If you’ve already done the background work here, skip to Step 2 .

Before you can answer the main question of Step 2 (choosing which type of TV channel to start), you should be able to answer the following questions:

  • How many hours of content do you have?
  • What type of content is it?
  • How does your audience prefer to consume this content?
  • What platforms are they already using?
  • Do you plan to offer any of your content via live streaming?

Question 1 & 2: How many hours of content do you have and what type of content is it?

The number of hours and type of content you have determine whether you have enough to run a linear TV channel or if you should instead pivot to a video on demand (VOD) experience.

For example, 60 hours of soft, soothing music with nature footage is enough for a linear TV channel because most users play it in the background. If it loops every week, most of them won’t mind.

On the other hand, viewers won’t enjoy sixty repeating hours of a cooking show, so it won’t perform well on linear TV.

Many of our clients have thousands of hours of content; if that is the case for you, linear TV is clearly a good choice. If you have less content, that doesn’t mean you can’t start a linear TV channel; it just means you need to be more careful making your program schedule and choosing which platforms you distribute it to.

Questions 3 & 4: How does your audience prefer to consume this content and what platforms are they already using?

A linear TV channel caters to the traditional “lean-back” TV experience as contrasted to the “lean-forward” experience of video-on-demand. VOD popularity is at its peak right now, but linear TV use is also surging on free ad-supported streaming TV (FAST) platforms like Roku, Samsung TV Plus, Vizio, Hulu, and more.

This is the classic system of watching TV (also called linear TV). Viewers sit back and watch the scheduled programs running on their chosen platform. They can switch between channels, but there’s no option to pause or forward (unless they’re using DVR technology). Some examples are Pluto TV and Samsung TV Plus.

Video-on-demand (VOD) allows viewers to discover and select content they want to watch on services like Netflix or Amazon Prime from any device (e.g., phone, laptop, or TV). Here, viewers have a choice to select from any of the content options available, with the option to pause, forward, or rewind.

Do you know if your audience prefers to consume your content through regularly scheduled programming or by binging your whole offering? Depending on your answer, you can choose to start a linear TV channel, a VOD channel, or both.

If you have any demographics or usage data that indicates which platforms your audience is already using, that will also help you plan distribution. For example, if you know that your audience is highly localized, then starting a channel on your local TV or finding a local online platform might be the best place to start.

Question 5: Do you plan to offer any of your content via live streaming?

Step 2: Decide which type of TV channel to start

There are four types of TV channels you can start:

  • A local broadcast TV channel
  • A cable channel
  • Your own TV app
  • A channel on an existing FAST platform

If you already know what type of TV channel you want to start, skip to Step 3 .

#1. Local broadcast

Running your own TV station requires millions of dollars of investment, massive technical infrastructure, and in most countries, a license for broadcast (For example, in the U.S., you need a license from the Federal Communications Commission or FCC.) You will likely need a consultant to guide you through local market analysis.

You’ll also need a large team with appropriate technical training to manage the broadcast.

For most content creators, establishing a local TV channel isn’t feasible. And even if it is, the costs involved often don’t justify the undertaking compared to FAST. That said, running a local broadcast is far more affordable with Amagi. You don't need to spend millions of dollars in investments because we handle playout for you.

#2. Cable channels/Traditional MVPDs (Multichannel Video Programming Distributors)

MVPDs deliver several channels as a package to subscribers through cable television or satellites. Some examples of MVPDs include DISH, Comcast, DirecTV, and Cox.

First, as a content creator, you need to strike a deal with the cable company. You must have very high quality content to be considered, in most cases. And even if you succeed in making a deal with a cable company, you still have to handle all technological issues yourself to deliver the content to them.

Second, though cable TV does still generate good revenue from ads, their market share is dropping rapidly. Most advertisers are now moving online. (They spent over $14 billion on connected TV in 2021, an increase of nearly 60% over the previous year.)

While cable or satellite tv channels can still be a good option, they’re usually only viable for large media companies with a presence on multiple platforms.

#3. Creating your own app

Platforms like Fire TV App or Roku TV app let you build apps for your own TV channels.

It’s a good option if you already have an audience. (For example, you may have an audience on a YouTube channel and then create an app for them.) But, you will have to keep building your audience once your app is created. You’ll also bear the cost of hiring developers to build and maintain the app for you, plus the cost of video hosting.

For example, television networks CondeNast and Tastemade first started on YouTube. After they attracted millions of viewers, they created their own app to host their TV channel.

#4. Free Ad-Supported Streaming TV (FAST) on existing platforms or apps

FAST services support linear, live, and on-demand channels. They can run on multiple devices like smartphones, tablets, laptops, and TVs. FAST is a type of OTT (over-the-top) TV because it is delivered via the internet instead of cable or a broadcast signal. FAST is usually the best option for content creators who have digital assets on platforms like YouTube, are already earning revenue from those platforms, and are confident that their video content will perform well on TV.

Step 3: Deliver content to the end-user platform

Content consumption happens on the video service platforms (VSPs) where people tune in to watch that content. Some examples include YouTube, Roku TV, and Sling TV.

Content quality

After your content is on Amagi’s platform, we ensure quality control to spot and fix technical errors. When you transfer content to a platform, there’s a chance of small technical failures, like a suddenly blank screen or moments of audio loss. Earlier, it was possible for any person or company to establish and operate a television channel. But in 2014, the Ministry of Information and Broadcasting had implemented some strict guidelines. If the interested company does not follow these guidelines, then it will not get the permission to operate the television channel.

Necessary net worth of channel owner

Only those companies will be allowed to open their own television channel, which possess a net worth of Rs. 5 crore. In case the company desires to operate a news channel, then it must have a net worth of Rs. 20 crore. Only those organisations, which fulfil the necessary requirements, will be able to apply for television channel licensing. To ensure the official seal, the company must start the news channel before the completion of one year, starting from the date of application submission. The company will utilise this time to gather technicians, journalists and other necessary teams. It is mandatory for the channel owner to keep all records of expenses. One can also prepare a business plan that will come in handy for running the channel smoothly.

Avenues to earn from the channels

After the television channel starts broadcasting programs, it is time for the authority to work out the way, which will bring in revenue. The main objective of most television channels is to make money. For this, the companies need to highlight their income sources. The primary revenue source for any television channel is by advertisements. The television channel owners will be able to sell slots to advertisers, and earn revenue. Another source of income is by broadcasting sponsored programs. One or more brands may be sponsoring the show. With the advent of the DTH connections, channels have another revenue source. The television channels can sell the programs to the DTH operators, and earn money.

Necessary tools and programs to operate the television channel

To start the channel, the channel owner must create a list of programs, which will be broadcasted. The type and nature of these programs will depend on the agenda of the channel. The authority needs to take into account the nature of the target audiences as well.

If the channel serves news, then the owners must construct a news studio setup. For other programs, necessary studio setup and filming must commence before the channel goes on air.

Once the content is ready, the technicians will come to the forefront. It is not possible for one person to monitor the entire channel. There is strict division of labour and responsibilities. The technical support team will operate gadgets for broadcasting the show.

The channel owners may shoot their own shows or down link content from another company. If the shows fail to keep the audiences hooked, then popularity of the channel will dwindle. It will have a direct effect on the overall revenue of the channel.

How to attain permit for the television channel?

The permit and registration of the channel depends on the type of content that the channel will broadcast. If the channel wishes to broadcast entertain shows, then it will have to apply for a registration accordingly. But the overall process is similar. Here are some steps that will help any interested person to apply for authorisation.

All television channels must have an up-link hub. Without this, the channel authority will not be able to broadcast the shows. The channel owner or respective authority will have to fill in application form, where they must highlight the main agenda of the channel. Then the application will be sent to the Ministry of Information and Broadcasting.

Once the ministry approves the channel up-link, then the channel owner will be able to broadcast shows in all parts of the country. To attain satellite links, the channel authority needs to get in touch with respective government agencies.

Once all documents are in order, the channel owner has to submit all details regarding the shareholding partners.

New TV channel for a startup in budget 2019

Finance Minister Nirmala Sitharaman has proposed the launch of a television channel in Union Budget 2019. The main aim of the launch is to boost Indian startups. The channel will be launched only for the startups as this would be like a platform in which issues about capitalists and the factors hindering the growth would be discussed. This would be of immense help for the startups as they would be guided towards the right path that would help them to run their startups smoothly. 

However, the responsibility for running the television will be given to the startup runners only. The channel would come under Doordarshan bouquet channels. It would also help the owners of startups to know better about funding planning. So, media boosting will help startups to know the easy ways of growth.

Startup India scheme helped entrepreneurs

The initiate of Startup India scheme has been beneficial for thousands of businesspersons that included individual from scheduled caste and tribes. Finance Minister is of the opinion that by the successful implementation of the scheme, the entrepreneurs have been assisted in setting up and executing business plans successfully. Owing to this, the state finance ministry has decided to continue with the scheme from 2020 to five long years.  So, effective implementation of the scheme would help develop and prosper 75,000 social entrepreneurs in India. This would include 20 technology business incubators and 80 livelihood business incubators.

How innovative strategies will help startups?

Even if startups are running in loss, they will get facilities under two circumstances. Either there should be continuity of 51% of shareholding or 100% original shareholders will get power of continuity. Also, while investing, the startups will not have to give capital gains relating to the sale of residential property. This eligibility criterion will be given to the startups for an extended time of two years. The startups can also sale the benefits before or on 31 st March, 2021. The minimum percentage of share capital has been relaxed from 50% to 25%. In case of transfer of assets, the time period has been reduced from 5 years to 3 years.    

In addition, the finance minister has proposed that in case of income tax filings, the startups in India will not be subjected to any kind of scrutiny. Both investor and other fund sources will be checked by means of e-verification in case of tax issues. 

Changing scenario of Indian startups

The Indian government has already made out ways that for improving the condition of startups in India. For the same, the government has promised to release funds for helping the startup owners. Finance Minister Piyush Goyal promised to provide an incentive to both startup owners and small business person that would help to simplify the condition of the entrepreneurs in India. Also, the government promised to achieve the idea of Digital India by 2030 that would include robotics and intelligence elements to simplify the works of the entrepreneurs. 

Therefore, by the successful launch of the above-said channel as proposed in the Finance budget would be of immense help for startup owners including small business enterprises to grasp better insight into the growth and promoting the business. The entrepreneurs can also gather adequate knowledge about tax planning and proper funding of their business.

Introduction

India’s TV industry earned about 788 billion Indian rupees in 2019, a growth of 6.5% with subscriptions and advertising revenues put together. Television will remain the largest earner of advertising revenues even in 2025, approaching INR 570 billion. A large share of this came from subscriptions, with over 500 billion rupees during that year. Although the consumption of online content is on the rise in the country, television remains just as central in Indian households with over 188 million TV households in the country in 2018. In fact, the rate of penetration of paid cable and satellite television was forecasted to amount to over 80 percent of households from 2019 to 2023. The highest amount of investment was made on television, followed by digital, radio, and gaming. The number of channels grew by 33 in 2019, 27 of which were from the non-news category and the total number of television channels reached 918. From this data, you can assess that starting your own TV channel can be a highly profitable business endeavor.

With the emergence of digitization of cable television service in 2012 came the need to amend the Cable TV regulations and thus the Government of India introduced a multi-phase digitization policy. One of the major advantages of the change in TRAI regulations was to break the monopoly of already established channels and pave way for competition in cable television networks. TV signals prior to the change in TRAI regulations were distributed in the country in analog as well as in digital and terrestrial formats. A digital format provides better picture quality & sound and other benefits leading to better quality service. Most cable operators in the country were providing analog TV service while all DTH operators are providing digital TV service. Digitization means that all cable TV households would receive digital TV signals through a Set-Top Box. As part of Digitisation, every cable operator will be legally bound to transmit digital signals, which can be received at the subscriber’s home only through a Set Top Box, often called an STB.

What are the different types of cable television networks?

Mode of TV transmission is mainly divided into two heads – Conventional and Modern Broadcasting System

(I) Conventional Systems includes old traditional broadcasting modes of transmission. They are as follows;

  • Analog Terrestrial TV

In this system, the television broadcasting doesn’t involve underground cables or satellite transmission. Some disadvantages of this system are that the clarity of the channel is not very good nor do signals get transmitted to remote village areas. The current televisions available in the market though are capable of receiving these signals. As the name suggests, the information about video and sound gets encoded as Analog signals. These signals consist of frequency and amplitude variations that get modulated into UHF or VHF carrier. The analog television draws the picture many times on display in the PAL system. Afterward, cable television or community antenna television (CATV) started substituting it. The Ministry of Information and Broadcasting issued a notification on 11 November 2011, setting 31 March 2015 as the deadline for a complete shift from analog to digital systems . In December 2011, Parliament passed The Cable Television Networks (Regulation) Amendment Act to digitize the cable television sector by 2014. 

  • Digital satellite TV

This is the current mandated way of delivering television signals by the TRAI digitization poilcy. In this system, the audience receives the signal through set-top boxes and satellite dishes. It provides an ample of channels, and services. You have to manage Uplink satellite dishes and other broadcasting equipment. In this system, satellites relay the signals with the uplink satellite dishes. These dishes are around 9 to 12 meters in diameter.  For transmitting the uplinked signals, the uplink dish is faced toward the particular satellite. After traveling a major distance, the downlinked satellite signals get weak, but the parabolic dish receives and reflects it to the focal point. A down converting device called LNB (low-noise block) is present at that focal point. It gathers, amplifies and converts the signals in the L-band range. Finally, you are able to see the channel through the set-top box. TV(I) Section in Broadcasting Wing is concerned with grant of licenses for uplinking/downlinking of TV channels, uplinking Hub/Teleport, uplink facility by a News Agency, permission for use of SNG/DSNGs and related regulatory aspects, as per the uplinking/downlinking guidelines, 2011 as amended from time to time. 

Prior digitization policy in India, this was the most prevalent transmission system. Transmission is carried through fixed coaxial cables. The coaxial cable bandwidth is capable of carrying signals for just hundred television channels, thus amplifiers are used to boost signals. It is used to distribute television channels to subscribers from a particular region. It is used for hosting local channels. Their content is usually relevant for people within that region.

(II)  Modern systems for broadcasting TV channels have developed over a period of time. They are as follows:

  • Digital Terrestrial TV

This technology provides a larger number of channels via aerial broadcasts to the traditional antenna rather than cable connection or satellite dish. It can also deliver high definition picture quality in MPEG-4/AVC coded into a 24 Mbit/s transmission channel. 

  • Video on Demand

In this system, users can watch the video in real time as per their demand through the cable network.  OTT is a subset of the overall VOD category and it is transmitted to the viewer via the internet without requiring users to subscribe to a traditional cable or satellite pay-TV service.

  • Internet TV Channel

It is a digital distribution of television content over the Internet. In fact, it has also revolutionized the conventional channels by hosting them. It is way better than coaxial cables in terms of signal quality, interference, signal lever, and potential of the transmission. IPTV uses the line which is also usually used by the subscribers to get broadband connectivity to their homes. This is a digital broadcast methodology, and it is an addressable mode using the Internet Protocol.

You can even start a web TV i.e. A normal TV channel hosted on a specific website like WordPress or app transmitting information via the Internet. It doesn’t require big investment. There are several softwares available online for starting a web tv. All you need is a webcam and a decent internet connection for getting things started. Prior to 2014, the registration of cable television networks was very easy, it was possible for any person or company to establish and operate a television channel. In 2014, The Ministry of Information and Broadcasting implemented stricter guidelines.

To provide an efficient and transparent regime for the growth and management of the Broadcasting Sector, an online portal “Broadcast Seva” has been developed and launched. The Broadcast Seva portal provides single point facilities to the various stakeholders and applicants for various permissions, registrations, licences etc. issued by MIB for broadcast related activities. According to 2011 Uplinking and Downlinking Guidelines, Net-worth Requirement is different in different cases i.e. for uplinking, downlinking, news, non-news etc. The same are given in uplinking and downlinking guidelines available on “broadcastseva.gov.in”. 

Uplink in simple words mean Upload and downlink means download. In broadcasting terms Uplink means the transmitter on the ground that sends signals up to a communications satellite and Downlink means A transmission path for the communication of signals and data from a communications satellite or other space vehicle to the earth and back.

As per Uplinking guidelines, to start a new Non-news channel or current affairs channel, the net worth of the company has to be INR 5 crore for the first channel. To apply for a new news channel the net worth of the company has to be INR 20 crore for the first channel. 

  • The Satellite TV channels acquires the permit for 10 years from the date of issue of permission.  
  • Permission fees per annum for uplink is Rs.2 Lakh for both News and Non-News current affairs channels. 
  • Registration fee for downlinking of TV Channels being uplinked from Abroad is 10 lakhs
  • Annual permission fee for downlink is Rs.5 Lakh per channel per annum uplinked from India and Rs.15 Lakh per channel per annum uplinked from Abroad.

In March 2020, the Ministry of Information and Broadcasting released new draft rules for Uplinking TV channels.

Content Development and Procurement

The cable television network has to decide the Genre of their channel. Some Examples of Genre are Entertainment, Music, News, Sports, Food, Regional language, etc. 

Accordingly, TV Channel companies will have to develop their own Original content for the channel. For creating their own unique content, the channel will have to invest in Studio Setup and Equipment and hire either a professional producer for shooting TV show. Producer will manage the crew required. Initially though Television network owner will have to hire appropriate administration staff, Content/script writers, Producers, Directors Actors and technical production crew that includes camera crew, light crew, and sound crew. After filming and processing the complete show and ensuring it follows the content guidelines laid down below, you can relay it on your channel. There are also entities functioning as Multi System Operators (MSOs) which mainly aggregate the contents from different broadcasters and then provide the signals for the same to last mile cable operators. For that TV channel has to enter into contracts to acquire broadcasting rights from the Producers of already curated content.

Regulatory frameworks of TV Content

The operation of Cable television network is regulated by The Cable television Networks Act, 1995 and Cable television network Rules, 1994. Telecom Regulatory Authority of India (TRAI) was established in 1997. The Broadcast wing of the Ministry of Information and Broadcasting is responsible for the regulation of content telecast on private satellite channels and transmitted/retransmitted through cable network in terms of the abovementioned Act and Rules.

In Rakul Preet Singh vs. Union of India & ors , the High court reiterated that Media house and television channels should show restraint in their reporting and abide by the provision of the Programmed Code as also the various guidelines, both statutory and self regulatory. 

In Tehseen S. Poonawalla vs Union of India , the Supreme Court held that the Central and state Governments should brodcast on radio and televison and other media paltforms including the official website of the Home Department and police of the states that lynching and mov violence of any kind shall invite serious consequences under the law.  The Ministry had thereby issued the advisory that ‘Mob Violence and lynching is a heinous crime and invites serious consequence nder the law. Mob violence and lynching is a serious criminal offence and invites stringent punishment under the law.

“ VTV” TV channel telecasted a news Viral Truth programme in which a man could be seen brutally beating up children in orphanage alleging taht incident happended in Valsad, Gujarat which was later found to be an incident in Egypt. The Central Government in exercise of its power conferred by Section 20 (2) and (3) in Cable Television networks (Regulation) Act had ordered to prohibit the transmission or re-transmission of ‘VTV’ TV channel for one day on any platfrorm throughout India with effect from 00:01 hrs on 16 December 2017 to 00:01 hrs on 17 December 2017

There are several Organisations which regulate the TV channels content quality. There are also organisations regulating specific types of content.

  • The Indian Broadcasting Foundation (IBF) is a non-profit organisation comprising news and non-news channels members managing about 90% of television viewerships. They have adopted a “Self Regulatory Content Code” and this determines quality of content.   • For news channels, the governing body is the News Broadcaster Association (NBA), the members of which have to follow “Code of Ethics and Broadcasting Standards”. (Refer – http://www.nbanewdelhi.com/assets/uploads/pdf/code_of_ethics_english.pdf )
  • IBF has also established BCCC (Broadcast Content Complaint Council)  which receives content related complaints. BCCC has issued several advisories relating to restriction on different type of content. (Refer – http://www.ibfindia.com/advisories )
  • Animal Welfare Board of India – to acquire permissions and non-objection certificate in using animals in TV/Film content.
  • National Commission for the Protection of Child Rights – providing guidelines for children artist (Refer – https://mib.gov.in/sites/default/files/Guidelines%20for%20Media%20reporting_0.pdf )

In A. K. Asthna vs. Union of India, the Court ordered committee comprising of representatives of Union of India, Government of NCT of Delhi and NGO working for welfare of children, representatives of media to deliberate upon the guidelines to be formulated to regulate media reporting and disclosure of details relating to children.

Content Protection

  • What are the IPRs involved in cable television networks

The main Intellectual property rights involved in Television and Media Industry is Copyright followed by Trademark. They are governed by The Copyright Act, 1957 and the Trademarks Act, 1999 respectively.

Copyright is a bundle of rights given by law to creators of original literary, dramatic, artistic, musical work and producers of cinematographic films and sound recordings. All audio-visual content falls under the purview of cinematographic films including TV shows. The term of copyright for literary, dramatic, artistic, musical work is 60 years from the death of the Author of work and in cinematographic films and sound recordings for 60 years following the year when it first published. Only after this term ends and the copyright enters in public domain, people are free to exploit the content any which way.

Trademark on other hand protects the Branding and goodwill of the business i.e. TV network in this case. According to Section 2 (1) (zb) of Trademarks Act, 1999 “trade mark” means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include shape of goods, their packaging and combination of colours. 

  • How do they work?

Copyright includes right to make copy of the content including a photograph of any image or any part as well as storing of the content in any medium by electronic or other means; to sell or give on commercial rental or offer for sale or rental any copy of the cinematographic film; the right to communicate to the public. Thus it is the exclusive right of the owner of copyright to exploit these rights. The TV channel company has the exclusive right to exploit the original content produced by them. They have the exclusive right to broadcast their original content on their TV channel. They can further choose to license and assign any or all of these rights for commercial gain. By doing so, the TV channel will acquire consideration money as revenue as well as royalty from the licensee/assignee as per the terms of the Contract entered into. 

On registration under Trademarks Act, TV channels brand name and logo are protected under Trademarks Act. Even the names of their TV Shows/programs and its format can be protected under Copyright and Trademarks Act. On registration, the owner of the trademark gets exclusive right to use that trademark for business as well as the right to stop others from using the same or similar trademark.

How can rights associated with operating cable television networks be protected?

If any individual exploits any right mentioned in Section 14 (d) of the Copyrights Act without the permit /license of the owner of copyright, the copyrighted work is infringed. And the owner of copyright has the right to sue and claim damages. 

Sometimes there are dispute with regards to format of show wherein one TV channel copies the format of other. Eg – Quiz based show (like KBC- kaun banega crorepati), Dating Shows (Love School), Survival Shows (like Man vs Wild). 

In its “TV format” judgment, the German Federal Court of Justice defined a TV program format as “the totality of all its characteristic features which are capable of acting as a general mould shaping each single episode and thus enable the audience at the same time to recognize such episodes easily as parts of a series”

The format rights which are copyrightable are only recognized in India mainly when there is breach of confidentiality clause in agreements. There is no statutory remedy to protect show formats.

TV Shows with same, common or similar names like the Registered Trademark of the TV channel if used / launched by another TV channel may impact the reputation of the Brand of TV channel and thereby amount to Trademark infringement. If there is no substantial distinguishing characteristic, it may create confusion in the minds of people and thereby the likelihood of confusion to the average person is an important factor in deciding trademark dispute cases. The aim of the case would be to protect the trademark of the TVchannel who has it registered. Unauthorized use of a trademark or service mark on competing or related goods and services also amounts to Trademark infringement.

  • Remedies in case of breach

In both Registered Copyright and Trademark infringement disputes, the owner and exclusive licensee of the IPR can avail both Civil and criminal remedies. 

Civil Remedies

Injunction is a preventive civil remedy wherein by the judicial process, the person who invades or threatens to invade the legal or equitable right of other is refrained and prohibited from continuing or commencing such act of infringement. In order to provide the owner of right an immediate relief and to prevent further damage to business in the course of lengthy full trial of case, the law provides interim relief of Interlocutory injunction to immediately stop the alleged infringement. These injunction continue till the end of the trial / hearing of the case and if the plaintiff succeeds in the trial in proving the infringement of his right, the court grants a permanent/ perpetual injunction to restrain future infringement.  

Mareva Injunction – This is a form of interlocutory injunction wherein the purpose of it is to prevent the defendant from disposing of the assets which maybe required to satisfy the claim of plaintiff. 

Anton Piller Order – In certain case the court of United Kingdom on the application of plaintiff makes ex parte order after a hearing in camera in the absence of the defendant, ordering the defendant to permit the plaintiff and his lawyers to inspect the premises. This order for the very first time was passed in Anton Piller AG V. Manufacturing Processes Ltd., where it acquires the name from. The order allows plaintiff and his lawyer to take possession of infringing copies/stock and relevant documents thus securing the evidence. 

John Doe Order – This order is issued against the unknown persons who have allegedly committed some wrong but their identity is not known to the Plaintiff. Herein, court has the power to injunct such person other than those impleaded in the suit.  

Damages – It is a compensatory remedy for the loss suffered by the plaintiff on account of infringement. It is awarded to restore the plaintiff to his position prior such infringement. 

In Microsoft Corporation vs. K. Mayuri , the court observed that the damages in case of where blatant infringing activities of defendant are found can be awarded under three heads;

  • Compensatory/ Actual damages – equivalent to the loss actually suffered by plaintiff
  • Damages to goodwill and reputation – on account of harming the reputation of plaintiff by unauthorized counterfeiting by the defendant of plaintiffs products.
  • Exemplary/punitive damages –  to create a deterring effect on defendant and all those who indulge in such infringing activity

Account of profits – Herein the infringing party is required to give up all his profits and gains made by selling infringed goods. It involves investigation of actual accounts, not merely notional computation. The account is of net profit after deduction of manufacturing and delivery cost. The plaintiff is entitled to either opt for damages or Account of profits, not both together. 

In Mohan Lal Gupta vs The Board of School Education, Haryana , the defendant was ordered to pay 20% of the profits to the plaintiff as the matter copied was less than one-tenth of the book.

Criminal Remedies

Under the Copyright Act, 1957 and Trademarks Act, 1999 the following are the basic remedies which are provided for infringement:

  • Imprisonment not less than 6 months which may extend to 3 years
  • Fine which may not be less than 50,000 but, may extend up to 2,00,000
  • Enhanced penalty on second or subsequent conviction.
  • Search and seizure of infringing goods
  • Forfeiture / Delivery of infringing goods to the registered right owner.

Revenue Generation

The main revenue source for any television channel is Advertisements. The television channel owners will be able to sell slots to advertisers, and earn revenue. Another source of income is by broadcasting sponsored programs. One or more brands may be sponsoring the show. With advent of the DTH connections and TRAI multi-phasic digitisation policy implemented, the channels have acquired another revenue source. The television channels can now sell the programs to the DTH operators.

The press has questions for Vice President Kamala Harris. She isn’t giving a whole lot of answers.

In the nearly three weeks since President Biden withdrew his candidacy, catapulting Ms. Harris to the top of the Democratic ticket, the vice president has shown little eagerness to meet journalists in unscripted settings. She has not granted an interview or held a news conference. On Thursday, after a rally in Michigan, she held her first “gaggle” — an impromptu Q.-and-A. session — with reporters covering her campaign.

It lasted 70 seconds.

Ms. Harris replaced a Democratic nominee who has hosted fewer White House news conferences than any president since Ronald Reagan. Now she is taking a similarly cautious approach, relying on televised rallies and prepared statements amid a tightly controlled rollout of her candidacy.

Asked on Thursday if she might sit for an interview anytime soon, Ms. Harris suggested that she would get through the convention first. “I want us to get an interview scheduled before the end of the month,” she said, as aides signaled to the scrum of journalists that question time was over.

Ms. Harris’s lack of engagement with the media has become a constant rallying cry on the political right, with Republican critics and Fox News stars accusing the vice president of ducking scrutiny. The Harris campaign says it is being thoughtful about how best to deploy its message, and to introduce a new candidate to crucial voters in battleground states.

Prime Minister Narendra Modi on Wednesday met Young Liu, the Chairman of Hon Hai Technology Group (Foxconn).

During the meeting, PM Modi highlighted the wonderful opportunities India offers in futuristic sectors. They also had excellent discussions on their investment plans in India in various states.

Foxconn, as one of the world’s largest electronics contract manufacturers, plays a crucial role in assembling a significant portion of Apple’s products, most notably the iconic iPhone.

Foxconn has been a crucial partner for Apple in its manufacturing operations, and their relationship is increasingly focused on India.

The Taiwanese giant has made significant investments in India to expand its manufacturing facilities, specifically targeting Apple products.

VINHEDO, Brazil (AP) — Brazilian rescue teams Saturday retrieved the remains of all 62 passengers from the wreckage of a plane crash in Sao Paulo state as families started gathering in the metropolis to identify and bury their loved ones.

Local airline Voepass’ plane, an ATR 72 twin-engine turboprop, was headed for Sao Paulo’s international airport in Guarulhos with 58 passengers and four crew members, when it went down in the city of Vinhedo.

Initially, the company said its plane had 62 passengers, then it revised the number to 61 and early on Saturday it raised the figure once again after it found a passenger named Constantino Thé Maia was not on its original list.

Voepass also said three passengers who held Brazilian identification also carried Venezuelan documents and one had Portuguese.

Sao Paulo state government said in a statement that rescue operations finished at 6:30 p.m. local time, with the identification of the bodies of the pilot and co-pilot by forensics experts. There were 34 male and 28 female bodies in the wreckage, the government said.

Earlier, Maycon Cristo, a spokesman for the local fire department, told journalists in Vinhedo that a winch was used to remove parts of the plane from the ground.

Brazilian authorities began transferring the corpses to the morgue Friday, and called on victims’ family members to bring any medical, X-ray and dental exams to help identify the bodies. Blood tests were also done to help identification efforts.

Images recorded by witnesses showed the aircraft in a flat spin and plunging vertically before smashing to the ground inside a gated community, and leaving an obliterated fuselage consumed by fire. Residents said there were no injuries on the ground.

Rain drizzled down on rescue workers as they recovered the first bodies from the scene in the chill of the Southern Hemisphere’s winter. Some residents of the gated community silently left to spend the night elsewhere. None were spotted returning on Saturday.

It was the world’s deadliest airline crash since January 2023, when 72 people died on board a Yeti Airlines plane in Nepal that stalled and crashed while making its landing approach . That plane also was an ATR 72, and the final report blamed pilot error.

Metsul, one of Brazil’s most renowned meteorological companies, said Friday there were reports of severe icing in Sao Paulo state around the time of the crash. Local media cited experts pointing to icing as a potential cause for the accident.

A video shared on social media channels Saturday shows a Voepass pilot telling passengers of a flight from Guarulhos to the city of Cascavel, the same origin of the crashed plane, that the ATR 72 has flown safely around the world for decades. He also asked passengers to be respectful to the memory of his colleagues and the company and asked for prayers.

“It was a fatality. The pilot was my personal friend. I have known all the crew from long ago,” the unidentified pilot said. “We are professionals, we have our families. This tragedy doesn’t hit only those who perished in this accident. It hits all of us. We are giving all our hearts, all our best to be here and fulfill our mission to take you safely and comfortably to your destination.”

Local police restricted access to the main entrance of one of Sao Paulo’s morgues, where bodies from the crash were being identified. Some family members of the victims arrived on foot, others came in minivans. They didn’t speak to journalists, and local authorities requested they not be filmed as they came.

A flight bringing more family members from Paraná state landed in the afternoon at Guarulhos international airport São Paulo, and they also chose not to speak to journalists. A minivan sponsored by the airline was set to transport them to the morgue.

Many family members were gathering at a hotel in downtown Sao Paulo, so far refusing to speak to media there too.

An American Eagle ATR 72-200 crashed on Oct. 31, 1994, and the United States National Transportation Safety Board determined that the probable cause was ice buildup while the plane was circling in a holding pattern. The plane rolled at about 8,000 feet and dove into the ground, killing all 68 people on board. The U.S. Federal Aviation Administration issued operating procedures for ATRs and similar planes, telling pilots not to use the autopilot in icing conditions.

But Brazilian aviation expert Lito Sousa cautioned that meteorological conditions alone might not be enough to explain why the plane fell in the manner that it did on Friday.

“Analyzing an air crash just with images can lead to wrong conclusions about the causes,” Sousa told the AP by phone. “But we can see a plane with loss of support, no horizontal speed. In this flat spin condition, there’s no way to reclaim control of the plane.”

Brazil’s air force said Saturday both black boxes of the plane had been sent to its analysis laboratory in the capital Brasilia. The results of its investigations are expected to be published within 30 days, it said.

Marcelo Moura, director of operations for Voepass, told reporters Friday night that, while there were forecasts for ice, they were within acceptable levels for the aircraft.

Likewise, Lt. Col. Carlos Henrique Baldi of the Brazilian air force’s center for the investigation and prevention of air accidents, told reporters in a late afternoon press conference that it was still too early to confirm whether ice caused the crash.

The plane is “certified in several countries to fly in severe icing conditions, including in countries unlike ours, where the impact of ice is more significant,” said Baldi, who heads the center’s investigation division.

In an earlier statement, the center said the plane’s pilots did not call for help or say they were operating under adverse weather conditions. There has been no evidence that the pilots tried to contact controllers of regional airports, either, Ports and Airports Minister Silvio Costa Filho told reporters Friday night in Vinhedo.

Brazil’s Federal Police said it began its own investigation, and dispatched specialists in plane crashes and the identification of disaster victims.

French-Italian plane manufacturer ATR said in a statement that it had been informed that the accident involved its ATR 72-500 model, and that company specialists are “fully engaged to support both the investigation and the customer.”

The ATR 72 is generally used on shorter flights. The planes are built by a joint venture of Airbus in France and Italy’s Leonardo S.p.A.

Crashes involving various models of the ATR 72 have resulted in 470 deaths going back to the 1990s, according to a database of the Aviation Safety Network .

Costa Filho, the airports minister, said the air force’s center will also conduct a criminal probe of the accident.

“We will investigate so this case is fully explained to the Brazilian people,” he said.

All television channels must have an up-link hub. Without this, the channel authority will not be able to broadcast the shows. Then the application will be sent to the Ministry of Information and Broadcasting.
