Preventing Workplace Harassment Training (Powerpoint)

What is considered workplace harassment.

In the United States, sexual harassment is a form of illegal employment discrimination that involves unwelcome sexual advances, requests for sexual favors, unfair conditions of employment and other types of verbal or physical conduct of a sexual nature in the workplace. 

Federal law describes harassment as a form of discrimination that occurs when an employee is subjected to unwanted behavior that insults and/or demeans. The behavior may be based on the victim’s race, color, national origin, gender, religion, or disability.

Most people are familiar with the concept of sexual harassment in the workplace. However, many employers mistakenly believe that sexual harassment is the only type of harassment that is illegal. Sexual harassment is actually just one form of unlawful workplace harassment. Harassment can include both verbal and physical behaviors. 

Defining Sexual Harassment

Sexual harassment is a type of sex discrimination that violates Title VII of the Civil Rights Act of 1964. 

The US has clear laws to prevent workplace sexual harassment; however, there are still incidents that occur. A lot of companies have started to implement their own sexual harassment training and prevention strategies. 

Sexual harassment is illegal in the United States and can lead to severe consequences if not handled properly by companies. Many companies have taken measures to prevent sexual harassment in the workplace, but a survey shows that only 50% of harassment incidents are reported.

So what is considered harassment ?

Examples of sexual harassment include unwelcoming sexual advances, requests for sexual favors, sexual innuendos on a person’s body, and other verbal or nonverbal/physical conduct of a sexual nature. If the individual refuses these advances, leading to unreasonable interferences in their employment and work performance, the creation of a hostile work environment, or any intimidating experiences, then it falls under harassing conduct.

Quid Pro Quo

There are many forms of harassment, which can include discrimination against sexual orientation, stereotyping or quid pro quo. 

Quid pro quo is Latin for “this for that.” It is a kind of workplace harassment where a worker is given the choice of either giving sexual favors or losing their job. A member of management may use quid pro quo to put pressure on their employees. The boss may also promise job benefits to the employee, such as a raise or promotion, in exchange for sexual favors.

Quid pro quo is considered illegal because it violates Title VII of the Civil Rights Act, which was passed in 1964 to prevent job discrimination based on race, color, religion, sex, and national origin. 

Hostile Environment

A hostile environment is a type of harassment where offensive conduct creates an environment so hostile (or abusive) that it is difficult for the employee to do their job.

It is a kind of harassment that involves offensive or intimidating conduct that is severe and persistent. It may come from co-workers or supervisors, or even clients. If you feel like your workplace has become an uncomfortable place to be due to the unprofessional or unwelcoming behavior of your co-workers or superiors, you can file a suit against such a hostile work environment.

Regulations Against Workplace and Sexual Harassment

There are mainly four major regulations that govern sexual harassment in the workplace. These include: 

The Civil Rights Act

The Civil Rights Act of the US, enacted in the year 1964, prohibits discrimination of employees based on religion, race, nationality, sex or complexion. The prohibition of discrimination against sex also includes transgendered people. 

The amendment in 1991 added provisions to Title VII, which also prohibits discrimination based on mere association with an individual of another race, religion, nationality or sex. The rights under Title VII expands the rights of women to sue and claim damages for sexual discrimination and harassment.

The Equal Employment Opportunity Commission

The EEOC is a federal agency established under the Civil Rights Act of 1964 for the purpose of enforcing civil rights laws in workplaces. This body investigates complaints made on the grounds of discrimination prohibited under the act. This commission also facilitates mediation and settlement of cases.

Barnes v. Train was the first sexual harassment case in America where an African woman was fired after refusing advances made by her supervisor. The case was dismissed but an appeal was made in 1977, Barnes v. Costle, where it was ruled that companies are liable for not stopping sexual harassment despite having knowledge of the same. A sum of $18,000 was awarded as compensation and the loss of promotions.

International Labour Organization

The USA joined the ILO in 1934. Article 2(d) of the ILO Declaration on Fundamental Principles and Rights at Work (1998) says that all members have an obligation to eliminate discrimination in employment and occupation.

International Treaties & Conventions

Article 7 of the UDHR, Article 26 of ICCPR and Article 2 of ICESCR clearly state that every individual is entitled to protection against any form of discrimination.

Tips to Prevent Workplace Harassment

Workplace harassment can be a major problem in both the USA and worldwide. It is not just about sexual harassment; it encompasses any kind of harassment in the workplace. US law imposes mandatory sexual harassment training requirements to be fulfilled.

As per EEOC charge data, the receipts of sexual harassment charges have fallen by 34.6% in 2021 compared to 2019 (7,514 charges in 2019; 5,581 charges in 2021).

Here are some tips on how you can deal with workplace harassment and prevent it from happening to you or others.

Help Employees Understand that Harassment is a Serious Offense

Harassment is a serious offense, and it’s important to establish that from the beginning. Harassing behavior in the workplace is not tolerated, which is why US law mandates all employers to provide sexual harassment and anti-harassment training periodically. 

Security awareness tips and anti-harassment training can help inform employees and non-employees (like interns) about harassment and help them avoid committing an offense or encourage others to do so. By creating a safe environment for everyone and making sure all employees understand what constitutes an offense, the organization can protect itself from legal action and maintain good relations with its employees. 

A little education can go a long way in preventing harassment and abuse of power in the workplace.

Make Known Who to Contact to Report Harassment

A major challenge to workplace harassment training in the USA is that many employees feel uncomfortable about who they should contact if they experience sexual harassment at work. The most important thing a company can do to prevent workplace harassment is to make sure that every employee knows how and to whom they can report harassment. 

Any employee who is subjected to sexual comments or harassment in the workplace should report to their manager or the immediate superior of their manager. The Human Resources department should also be equipped with the right team to handle complaints covering the various types of sexual harassment. It is the duty of all supervisors and managers to take responsibility and investigate every such complaint.

Investigating Harassment Complaints in a Timely Manner

To ensure that allegations of harassment are dealt with in a timely manner, employers should establish procedures for the prompt investigation of complaints. Even if an employer has not received any harassment complaints, they should still create and document policies for the prompt investigation of complaints.

Employers should have a strong anti-harassment policy and it should be a part of the employee handbook and also be posted prominently on the workplace page.

Help Managers Understand Their Responsibilities in Preventing Harassment

As important as it is to train your employees on how to identify and deal with harassment in the workplace, it is also important that you train your management and executive group (employers) on how to take corrective actions and prevent such incidents. It is the duty of an employer/manager to create a safe and healthy work environment for all their employees.

Every manager and employer has a responsibility to take appropriate measures to ensure that harassment in the workplace can be prevented, and they should also be trained on how to deal with an incident involving a complaint against another co-employer or employee.

An employee is defined as a person who is employed at a workplace for any work on a regular, temporary, ad hoc, or daily wage basis; directly or indirectly through a third party, including a contractor; with or without the knowledge of the primary employer.

This slide gives the definition of a domestic worker as an important stakeholder in case of sexual harassment. The term domestic worker refers to any person who is engaged in domestic work (work done in or for a household or households) within an employment relationship.

An aggrieved woman includes a woman of any age, regardless of her employment status, who claims to have been subjected to any act or behavior of sexual harassment by a respondent in relation to a workplace.

Instructors’ Notes:  In 2019, the U.S. Equal Employment Opportunity Commission (EEOC) received over 7,500 claims of sexual harassment, resulting in a payout of $68 million in direct settlements.

New York State Law requires that employers of one or more employees must conduct sexual harassment prevention training for all employees each year. New York City Law also has training requirements for employers. To learn about NYC requirements, please see the  Frequently Asked Questions . The Commission has developed an online training that will satisfy both the New York State and New York City sexual harassment prevention training requirements.

At the bottom of this page, you will find links to the online training in multiple languages.

  • In NYC, employers must keep a record of employees’ training and must retain records for three years.
  • If you are taking this training on a desktop computer or laptop, you will be able to print or save the certificate to your computer. At the end of the training,  you must click the “SAVE” button first   in order to generate your certificate of completion.
  • If you are on a mobile device, you can use the device’s capabilities to take a screenshot, save, or email the certificate.
  • Your employer should tell you before you take the training how they want to receive the certificate.
  • Please note: When you are taking the training, you cannot save your progress. Do not refresh the page, as you may lose your place and have to restart the training.

The training:

  • The training takes approximately 45 minutes.
  • You can take the training on a computer or a phone.
  • This training requires Chrome 67 (or later), Firefox 66.0.4 (or later), or Safari 11.1.1 (or later).

Required Postings and Fact Sheets:

New York City employers of 15 or more, or 1 or more domestic workers, are required to do both items below in addition to the annual training:

  • post a sexual harassment prevention poster  in English  and  in Spanish  in an obvious place
  • give new employees a sexual harassment prevention  fact sheet

Note: New York State requires that all employers have a sexual harassment prevention policy. The State Department of Labor has published a  model policy .
